Panther Fantasy, Panther Fantasy.com ,or its affiliates, subsidiaries, associates and partners hereafter could be referred as ‘Panther Fantasy,‘Panther Fantasy.com ' ‘We’, ‘Us’ and ‘Our’.


2. Usage of Panther Fantasyapplication and Admin Panel


Any user accessing Panther Fantasyapplication or website for the use participating in the various contests and games (including fantasy games), gaming services, being conducted on Panther Fantasyapplication ("Contests") shall be bound by these Terms and Conditions, and all other rules, regulations and terms of use referred to or offered by Panther Fantasyin relation to any Panther FantasyServices.


We reserve all the rights to modify or change the already defined Terms and Conditions, rules, regulations, and terms of use at any point in time, by posting the same on Panther Fantasyapplication or www.Panther Fantasycom website. Panther Fantasyconstitutes the acceptance and agreement of the individuals using Panther Fantasyservices towards time to time amendments that can be made in the Terms and Conditions, rules, regulations, and terms of use already defined by us. Users can be informed about the amendments in these Terms and Conditions, rules, regulations, and terms of use by sending an email to the Member’s and User's registered email address or posting notifications in the User accounts. if user disagrees or does not accepts the amendments in the Terms and Conditions, rules, regulations, and terms of use can use the options provided in such an email or notification to indicate their non-acceptance within a defined time frame. If a user fails to indicate their non-acceptance of the amendments within the defined time period the users are bound to accept the changes or modification in these Terms and Conditions, rules, regulations, and terms of use. In case the user disapproves/ rejects to accept the amendments in these Terms & Conditions, rules, regulations, and terms of use, then Panther Fantasywill not allow user to use Panther FantasyServices.


A range of Panther FantasyServices being offered on Panther Fantasyapplication or website may be subject to additional rules and regulations settled down in that respect. To the extent that these Terms and Conditions are inconsistent with additional conditions set down, additional conditions shall prevail.


Panther Fantasymay, at its sole and absolute judgment:

  1. Restrict, suspend, or terminate any User’s access to all or any part of Panther Fantasyor Panther FantasyServices;
  2. Change, suspend, or discontinue all or any part of Panther Fantasyservices;
  3. Deactivate or delete a User’s account and all related information and files on the account;
  4. Reject, move, or remove any material that may be submitted by a User;
  5. Move or remove any content that is available on Panther Fantasyapplication or website;
  6. Establish general practices and limits concerning use of Panther Fantasy
  7. Revise or make additions to the list of user’s available for selection in a Contest on account of revisions to the list of Users involved in the pertinent Sports Event;
  8. Assign its rights and liabilities to all Users accounts hereunder to any entity (post intimation of such assignment shall be sent to all Members and Users to their registered email ids)
    9. .

If any user(s) breaches, or Panther Fantasy reasonably believes that such user(s) has breached these Terms and Conditions, or has illegally or inappropriately used Panther Fantasyor the Panther FantasyServices, We may, at its sole and absolute discretion, and without any notice to them, restrict, suspend or terminate their access to all or any part of Panther Fantasyor the Panther FantasyServices, deactivate or delete the user's account and all related information on the account, delete any content posted by the user(s) on Panther Fantasyand further, take technical and legal steps as per consideration under these terms and conditions.


If we charge user(s) a platform fee in respect of any Panther FantasyServices, shall, without delay, repay such platform fee in the event of suspension or removal of Member(s) or their user’s account or Panther FantasyServices on account of any negligence or deficiency on the part of Us , but not if such suspension or removal is effected due to:

  1. any breach or inadequate performance by the user of any of these Terms and Conditions; or
  2. all situations beyond the reasonable control of Us.

Users consent to receiving communications such as announcements, administrative messages and advertisements from Panther Fantasyor any of its partners, licensors or associates.


3. INTELLECTUAL PROPERTY


Panther Fantasyapplication comprises of a combination of content created by Nilee Games and Future Technologies Pvt Ltd and it’s associates. The intellectual property rights ("Intellectual Property Rights") in all software underlying Panther Fantasyand the Panther FantasyServices and material published on Panther Fantasyapplication, admin panel and website, including (but not limited to) games, Contests, advertisements, software, source code, photographs, written content, images, graphics, marks, illustrations, audio, logos or video clippings and animation, is owned by Nilee Games and Future Technologies Pvt Ltd and its associates. Users may not transmit, publish, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on Panther Fantasyand Website either in whole or in part without express written license from Nilee Games and Future Technologies Pvt Ltd .


Users may request permission to use any Panther Fantasycontent by writing in to Panther FantasySupport.


Users confirm and undertake to not display or use of the names, marks, logos, trademarks, labels, copyrights or intellectual and proprietary rights of any third party on Panther Fantasy Members and Users agree to cover and hold harmless Panther Fantasy its directors, affiliates, employees and assigns against all costs, loss and harm including towards litigation costs and counsel fees, damages, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, marks, logos, trademarks, labels, copyrights or intellectual rights on Panther Fantasy by such user or through the user’s commissions or omissions.


Users hereby grant to Panther Fantasyand its affiliates, partners, licensors and associate a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish User’s Content for any of the following purposes:

  1. displaying Users’ Content on Panther Fantasy/li>
  2. distributing Users’ Content, either by machine or via other media, to other Users looking for downloading or else get it, and/or
  3. storing Users’ Content in a remote database accessible by end Users, for a charge.

This license shall apply to the distribution and the storage of Users' Content in any form, medium, or technology.


All names, marks, logos, trademarks, labels, proprietary rights and copyrights or intellectual rights on Panther Fantasybelonging to any person, entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to Panther Fantasy


4. THIRD PARTY SITES, SERVICES, AND PRODUCTS


There may be various links to other Internet sites owned and operated by third parties on Panther Fantasyapplication and its website which may contain different conditions for users' use of the website and application. Panther Fantasyauthorities do not hold any control or responsibilities for internet sites apart from Panther Fantasyapplication and its website, and thus, it shall not be held responsible for any content posted on any third party Internet site. Further, the involvement of Panther Fantasywith any of the third-party content or links to third-party Internet sites is not related to any sort of endorsement by Panther Fantasyof such third-party Internet site.


Panther Fantasyis neither associated with nor responsible for the correspondence, transactions, and all other related activities between users and third parties including payment providers and verification service providers on Panther Fantasy User’s involvement with third parties is entirely dependent on the terms and conditions, policies and services terms of these third parties and Users are solely responsible for reviewing the policies, terms and conditions, and the service terms of these third parties before transacting or availing any of the services. Accepting the Terms and Conditions of Panther Fantasy, Users agree that Panther Fantasyis not responsible for any sort of damage or loss faced by Users due to any sort of transactions, correspondence and all related activities with any of the third parties. Any questions, complaints, or claims related to any third party product or service should be directed to the appropriate vendor.


Panther Fantasycomprises a group of content created and posted by either Panther Fantasyas well as various third parties. Panther Fantasydoes not hold responsible for the accuracy, integrity or the quality of the content created and posted by any of the third parties and such content may not be relied upon by the Users in terms of using the Fun Features provided by the Panther Fantasyplatform or taking part in any of the contests hosted on the Panther Fantasyplatform.


5. PRIVACY POLICY


You agree to comply with Our privacy policy, guidelines and statements as may be applicable from time to time, which are incorporated into these Terms, and can be found at Privacy Policy.


6. USER(s) CONDUCT


The Terms and Conditions, rules, regulations and terms of use defined by Panther Fantasyfor user(s) are mandatory to be followed by user(s) and in an event if user(s) fails to follow the Terms and Conditions, rules, regulations, and terms of use adequately the authorities of Us reserves all the rights to take action against such user, which might include (but not limited to):


  1. Restricting, suspending, or terminating any user(s) access to all or any part of Panther Fantasyservices;
  2. Deactivating or deleting a user(s) account and all related information and files on the account; or
  3. Refraining from awarding any prize(s) to such User(s) li>

By accepting the Terms and Conditions of Panther Fantasy the individual’s using services provided by Panther Fantasyagree to provide true, accurate, current and complete information while registration and at other times when demanded by Panther Fantasy The individuals further provide consent to keeping their registration information updated.


A single user is permitted to register or operate only one user account with Panther Fantasy(inclusive of both web & app).


The individuals using the services provided by Panther Fantasyprovide their consent for receiving all the communications from Panther Fantasyby marking e-mails from Panther Fantasyas part of their "safe senders" list. In an event, if any of the emails sent by Panther Fantasyremains unread by the user because of being sent to the Spam or Junk folders, Panther Fantasyshall not be held responsible.


Any sort of password issued by Panther Fantasyto any of the individual using the services provided by Panther Fantasyare confidential and should not be shared by user(s) with anyone else. User(s) hold the sole responsibility of maintaining the confidentiality of their accounts and passwords. User(s) offer their consent by agreeing to the Terms and Conditions of Panther Fantasyto inform Panther Fantasyabout any unauthorized use of their passwords or accounts or any other breach of security.


User(s) are solely responsible for the security and confidentiality of his/her payment accounts linked to his/her Panther Fantasyaccount. In case of any misuse of the linked payment accounts of user(s), Panther Fantasyshall not be held liable; further, such misuse of the linked payment accounts of user(s) should be reported to Panther Fantasyor payment vendors as soon as it comes to the notice of user(s).


The individuals using services provided by Panther Fantasyshould neither conduct nor assist the usage of cheats, exploits, automation, software, bots, hacks or any unauthorized third-party software specifically formulated for modifying or intervening with Panther Fantasyservices and/or Panther Fantasyexperience.


The individuals using services offered by Panther Fantasyprovides their consent of not copying, modifying the technology and software associated with Panther Fantasyservices. Further, user(s) accept not to rent, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to anyone of the associated technologies and software.


The Terms and Conditions of Panther Fantasybounds user(s) to neither modify nor become a cause of modification of any of the files, technology or software associated with Panther Fantasy


User(s) provide their acceptance to not to disrupting, overburdening, or promoting any kind of disruption or overburdening to:


  1. The servers or computers offering or supporting Panther Fantasyservices;
  2. The enjoyment of Panther Fantasyservices by other Users or persons;

The Terms and Conditions of Panther Fantasydo not permit user(s) to attain any sort of unauthorized access to user(s) accounts, Servers or networks associated to Panther Fantasyservices by any means except the user interface provided by Panther Fantasy User(s) must not indulge in activities like circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software associated with the service provided by Panther Fantasy


User(s) provide their acceptance for not using the Panther Fantasyplatform for any sort of inadequate activities including (but not limited to):

  1. To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication;
  2. To harass, stalk, threaten, or otherwise violate any legal rights of other individuals;
  3. To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, Panther Fantasyany software, hardware, or telecommunications equipment;
  4. To advertise, offer or sell any goods or services for any commercial purpose on Panther Fantasywithout the express written consent of Panther Fantasy
  5. To Transmit content regarding services, products, surveys, contests, pyramid schemes, spam, unsolicited advertising or promotional materials, or chain letters;

User(s) are bound to accept that they will neither support or conduct any sort of attack including (but not limited to) distribution of a virus, denial of service, or other attempts to interrupt the services provided by Panther Fantasyor the use or enjoyment of other Panther Fantasyusers.


7.REGISTRATION


In order to register for the membership of subscription for their Fantasy Sports Business and their user(s) to participate in the Contest(s), both are required to provide the following information accurately:


  1. Full Name
  2. Contact Number
  3. E-mail address
  4. Password
  5. State of Residence
  6. Gender
  7. Date of birth

The “Full Name” and “Date of Birth” mentioned by the members and users for the purpose of verification should match with the Name and Date of Birth mentioned on all the documents required to be uploaded for verification purposes.


The people participating in activities, services or features provided by Panther Fantasyare required to provide their approval stating they have carefully read all the terms and conditions and will comply with all the rules, regulations and terms of use of Panther Fantasy


The users entering any contest(s) organized by us as a resident of Assam, Odisha, Telangana, and Nagaland will not be permitted to sign up for any round in the paid version of the Contest as elaborated below. In case of audits from Panther Fantasyor Subscribed Member(s), if a user is found to be a resident of Assam, Odisha, Telangana or Nagaland but not stated at the time of registration then Panther Fantasyat its sole and absolute discretion holds the rights to take action against such user including (not limited to) blocking of user account, deletion or deactivation of user account, and resetting the user account to initial level by deleting all the logs, refers & reducing the amount present in the user wallet to “zero.”


The members and users who are above the age of 18 years and have successfully completed their registration process by entering valid and adequate information in the registration form are sent a confirmation email comprising their login details.


In case of PAN card verification, any scanned image of a photocopy of the users’ PAN card will not be acceptable. For PAN card verification it is mandatory to upload a full image of the original PAN card.


In case, you are uploading an E-PAN card for PAN card verification process then it is mandatory to upload a full scanned image of the E-PAN card (both front and back).


8. CONTESTS, PARTICIPATION AND PRIZES


Currently, there are paid and Free versions of the Contests made available by Panther Fantasyfor users. Their users may participate in the Contests by paying the pre-designated amount as provided on the relevant Contest page created by Panther Fantasy The Participant with the highest aggregate points at the end of the pre-determined round shall be eligible to win a pre-designated prize, as stated on the relevant Contests page.


A Participant may create different Teams for participation in Contests offered in relation to a Fantasy Sport Event across the Panther FantasyServices provided to user(s). However, unless we specify otherwise in relation to any Contest ("Multiple Entry Contest"), Participants acknowledge and agree that they may enter only one Team in any Contest offered in relation to a Fantasy Sport Event. In the case of a Multiple Entry Contest, a Participant may enter more than one Team in a single Multiple Entry Contest, however on submitting more than one Team for participation in a single Multiple Entry Contest, the Participant will not be permitted to edit or revise the Teams so submitted for participation in such Multiple Entry Contest. In addition, it is expressly clarified that Panther Fantasyor user(s) may, from time to time, restrict the maximum number of Teams that may be created by a single user account (for each format of the Panther FantasyServices) or which a single User account may enter in a particular Multiple Entry Contest, in each case to such number as determined by Panther Fantasyor user(s) in its sole discretion.


User(s) shall collect a pre-designated fee to access the Contests.


In the event a Participant indicates, while entering an address, that he/she is a resident of either Assam, Odisha Telangana or Gujarat, such Participant will not be permitted to proceed to sign up for the round or contest and may not participate in any paid version of the Contests.


9. ELIGIBILITY


The Contests and subscription based Fantasy Sports business are open only to persons above the age of 18 years.


The Contests and subscription based Fantasy Sports business are open only to persons, currently residing in India.


Panther Fantasymay, in accordance with the laws prevailing in certain Indian states, bar individuals residing in those states from participating in the Contests. Currently, individuals residing in the Indian states of Assam, Odisha,Telangana or Gujarat may not participate in the paid version of the Contest as the laws of these states bar persons from participating in games of skill where participants are required to pay to enter.


Persons who wish to participate must have a valid email address.


Only those Participants who have successfully registered on the Panther Fantasyas well as registered prior to each round in accordance with the procedure outlined above shall be eligible to participate in The Contests and subscription based Fantasy Sports business.


10. LEGALITY OF GAME OF SKILL


Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867. The Indian Supreme Court in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153) has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience, and adroitness of the User shall be classified as a game of skill.


The Contest (s) described above (across the Fun Features) are games of skill as success of Participants depends primarily on their superior knowledge of the games of cricket, football, cricket statistics, football statistics, knowledge of Users’ relative form, Users’ performance in a particular territory, conditions and/or format (such as ODIs, test cricket and Twenty20 in the cricket fantasy game), attention and dedication towards the Contest(s) and adroitness in playing the Contest(s). The Contest(s) also requires Participants to field well-balanced sides with limited resources and make substitutions at appropriate times to gain the maximum points.


By participating in this Contest(s), each Participant acknowledges and agrees that he/she is participating in a game of skill.


11. PAYMENT TERMS


b. For user(s)


In respect of any transactions entered into on the Panther FantasyServices, including making a payment to participate in the paid versions of Contests, user(s) both agree to be bound by the following payment terms:


  1. The user(s) make to participate in the Contests is inclusive of the nominated fee for access to the Panther Fantasyervices charged by us. Subject to these Terms and Conditions, all other amounts collected from the user(s) are held in escrow until determination of the Winners and distribution of prizes.
  2. The Panther Fantasy application hosts a number of Contests for which it reserves the right to charge a Platform Fee, which would be specified and notified by us on the Contest page prior to a user’s joining of such Contest. The Platform Fee and applicable tax there on will be debited from the user’s account balance along with the entry-fee for the Contest, and we issue an invoice for such debit to the user.
  3. The user may participate in a Contest wherein the user has to contribute a pre-specified contribution towards the Prize Money Pool of such Contest, which will be passed on to the Winners of the Contest after the completion of the Contest as per the terms and conditions of such Contest. It is clarified that we have no right or interest in this Prize Money Pool, and only acts as an intermediary engaged in collecting and distributing the Prize Money Pool in accordance with the Contest terms and conditions. The amount to be paid-in by the user towards the Prize Money Pool would also be debited from the user’s account balance with us.
  4. Panther Fantasyprovides user(s) with three categories of accounts for the processing and reconciliation of payments in relation to the Panther FantasyServices: (i) 'Unutilized' Account, (ii) Winnings Account, and (iii) Cash Bonus Account.
  5. The user’s winnings in any Contest will reflect as credits to the user’s Winnings Account. It is clarified that in no instance will Panther Fantasypermit the transfer of any amounts in the user’s accounts to any other category of account held by the user with Panther Fantasyor any third party account, including a bank account held by a third party.
  6. The payment made shall be credited to the User’s accounts and each time a user enters a round, the applicable amount towards participation in the round shall be debited from the user’s account. In debiting amounts from the user’s accounts towards the participation fee of such user in any round or Contests, We shall first debit the User’s Cash Bonus Account (in accordance with any rules or limitations relating to the use of Cash Bonus as may be prescribed by Panther Fantasyand applicable at such time) , thereafter, any remaining amount of participation fee shall be debited from the User’s Unutilized Account and thereafter, any remaining amount of participation fee shall be debited from the User’s Winning Account. In case there is any amount remaining to be paid by the user in relation to such User’s participation in any rounds or Contests, the user will be taken to the designated payment gateway to give effect to such payment. In case any amount added by the user through such payment gateway exceeds the remaining amount of participation fee, the amount in excess shall be transferred to the User’s ‘Unutilized’ Account and will be available for use in participation in any rounds or Contests or for withdrawal in accordance with these Terms and Conditions. Debits from the ‘Unutilized’ Account for the purpose of enabling a User’s participation in a Contest shall be made in order of the date of credit of amounts in the ‘Unutilized’ Account, and accordingly amounts credited into ‘Unutilized’ Account earlier in time shall be debited first.
  7. A user shall be permitted to withdraw any amounts credited into such User’s 'Unutilized' Account for any reason whatsoever by contacting our Customer Support. All amounts credited into a User’s ‘Unutilized' Account must be utilised within 335 days of credit. In case any unutilised amount lies in the 'Unutilized' Account after the completion of 335 days from the date of credit of such amount, we reserve the right to forfeit such unutilised amount, without liability or obligation to pay any compensation to the User.
  8. Withdrawal of any amount standing to the User’s credit in the Winnings Account may be made by way of a request to us but shall occur automatically upon completion of 335 days from the date of credit of such amount in the User’s Winnings Account. In either case, we shall effect an online transfer to the User’s bank account on record with us within a commercially reasonable period of time. Such transfer will reflect as a debit to the User’s Winnings Account. We shall not charge any processing fee for the online transfer of such amount from the Winnings Account to the User’s bank account on record with us. Users are requested to note that they will be required to provide valid photo identification and address proof documents for proof of identity and address in order for Panther Fantasyto process the withdrawal request. The name mentioned on the user’s photo identification document should correspond with the name provided by the user at the time of registration on Panther Fantasyapplication , as well as the name and address existing in the records of the user’s bank account as provided to us . In the event that no bank account has been registered by the User against such User's account with us , or the User has not verified his/her User account with us, to our satisfaction and in accordance with these Terms and Conditions, We shall provide such User with a notification to the User’s email address as on record with us at least 30 days prior to the Auto Transfer Date, and in case the User fails to register a bank account with his/her User Account and/or to verify his/her User Account by the Auto Transfer Date, We shall be entitled to forfeit any amounts subject to transfer on the Auto Transfer Date. Failure to provide us with a valid bank account or valid identification documents (to our satisfaction) may result in the forfeiture of any amounts subject to transfer in accordance with this clause.
  9. The Cash Bonus Account shall contain amounts gratuitously issued by us to the user for use in participation in any Contests and no User shall be permitted to transfer or request the transfer of any amount in to the Cash Bonus Account. The usage of any amounts issued and present in the Cash Bonus Account shall be
  10. subject to the limitations and restrictions, including without limitation, restrictions as to time within which such amount must be used, as applied by us and notified to the user at the time of issue of such amount. The issue of any amount to the Cash Bonus Account is subject to the sole discretion of ours and cannot be demanded by any user as a matter of right. The issue of any such amount by us on any day shall not entitle the User to demand the issuance of such amount at any subsequent period in time nor create an expectation of recurring issue of such amount by us to such User. The amount standing to the credit of the User in the Cash Bonus Account may be used by such User for the sole purpose of setting off against the participation fee in any Contest, in accordance with these Terms and Conditions. The amount standing to the credit of the User in such User's Cash Bonus Account shall not be withdraw-able or transferrable to any other account of the User, including the bank account of such User, or of any other User or person, other that as part of the winnings of a User in any Contests. In case the User terminates his/her account with us or such account if terminated by Panther Fantasy all amounts standing to the credit of such User in the Cash Bonus Account shall return to Panther Fantasynd the User shall not have any right or interest in such amounts.
  11. Users agree that once they confirm a transaction on Panther Fantasy they shall be bound by and make payment for that transaction.
  12. A transaction, once confirmed, is final and no cancellation is permissible. However, we may, at its sole and absolute discretion, permit a User to cancel a transaction and refund the amount paid:
    1. If the User sends a written request to us from the registered email Id to cancel such payment; or
    2. If the payment is made for participation in the paid versions of the Contests, the cancellation request must be received at least 2 days prior to the commencement of the round in respect of which the payment is made;
  13. Panther Fantasy or its associates shall not be liable to refund any amount thereafter.

12.SELECTION AND VERIFICATION OF WINNERS AND CONDITIONS RELATING TO THE PRIZES


SELECTION OF WINNERS


We will select winners on the basis of computation and tabulation of scores in a designated round (which may last anywhere between one day and an entire tournament) of the Contest(s). An individual whose team will score the highest aggregate of points based on the on-field performance of their selected Users will be declared as winners by us. Any individual identified by Panther Fantasyas creating a team on behalf of other users will be disqualified from the Contest(s). In an event wherein there's a tie between the winners, then the winning users shall be declared as the winners, and the prize shall be equally divided among such Participants. If the users have not complied to the Terms and Conditions defined by Panther Fantasy, then, Panther Fantasyshall not be liable to pay any prize in relation to the use of the Panther Fantasy application, Contest, "Fantasy Rules," etc.


CONTACTING WINNERS


Panther Fantasyshall contact winners of the contest(s) through email, mobile or both provided by the user at the time of registration on our dedicated application. We shall share details to the users about the documents required for the collection of the prize at this stage. As a general practice, winners will be required to provide the following documents:


  1. Original scanned copy of the User’s PAN card.
  2. User’s bank account details and proof of the same.

An individual shall not be allowed to withdraw his/her prize without the submission and verification of the above mentioned documents within the time-period defined by us. By accepting these Terms and Conditions, the users ensure that the documents provided at the time of verification are the true copies of the original documents.


The users are bound to provide adequate and complete details at the time of registration. Subscribed member(s) shall not be held responsible for any sort of communication, commissions or omissions that might lead to a situation wherein the results may not be communicated to the Winner.


We shall publish the list of the winner(s) and informing the winners through e-mail, app or mobile.


VERIFICATION PROCESS


We are authorized only to permit the user(s) who have successfully completed the verification process by providing the required documents within the time limit specified by us to withdraw/receive their accumulated winnings (or any part thereof). Any request for extending the time-limit for verification and document submission shall not be accepted by us


We are authorized to disqualify any winner from withdrawing their accumulated winnings post scrutinizing all documents (or any part thereof) on the following grounds:


  1. If we identify that any of the document or information provided by the user at the time of verification is inadequate, incorrect, misleading, false, fabricated, incomplete or illegible; or
  2. Participant does not fulfill the Eligibility Criteria specified; or
  3. Any other ground.

Any winner who is winning any paid contest authorizes Panther Fantasyto use images and names of the winners on social media platform and to display on pages, ads of Panther Fantasyas and when needed. In case, any user disagrees to this, no withdrawal shall be processed, and the user will not be allowed to play further on Panther Fantasy.


TAXES PAYABLE


The prizes offered to the users declared as winners of the contest(s) organized by their us comply with a deduction of tax ("TDS") under the Income Tax Act 1961. In an event wherein such tax deductions are made, the winners will be provided TDS certificates. The individuals declared as winners agree to pay other applicable tax, including (but not limited to) income tax, gift tax, etc. in respect of the prize money.


FREE LEAGUE


If we organizes Contest(s) in Free League formats wherein it enables its users to win cash prize without paying any entry charges for the leagues. In an event wherein any user wins the free league organized by us the winning amount will get transferred to the user’s account which can be used only for joining further paid leagues organized by us. The winning amount cannot be used or withdrawn for any other purpose except for joining other leagues or its solely ours decision.


Panther Fantasyholds all the rights to disqualify a participant alongside forfeiting the prize of such participants at its sole and absolute discretion, in an event wherein an individual below the age of 18 years is identified playing the paid formats of the Contest(s) organized by Panther Fantasy. In addition to this, Panther Fantasycan suspend or terminate the accounts of such participants. Panther Fantasy shall not be held liable for the quality, suitability, and merchantability of the prizes as Panther Fantasymakes no warranties about the same to the extent permitted by legal authorities.


Panther Fantasyis authorized to modify or change the prizes offered to the participants declared as the winners of Contest(s) organized by Panther Fantasy and the participants not raise any claim or question the decision of Panther Fantasyrelated to the prize modification.


Panther Fantasyshall not be held responsible or liable for any sort of damage or loss to the prizes occurring at the time of transportation.


Any sort of transportation charges including shipping and courier are to be undertaken by the Panther Fantasy in respect of the prizes.



The prizes given to the participants declared as the winners of Contest(s) organized by Panther Fantasyare non-transferable and non-refundable. The winners can neither exchange/redeem those prizes for cash or kind.


13. TABULATION OF FANTASY POINTS


Panther Fantasymay obtain the score feed and other information required for the computation and tabulation of fantasy points from third party service providers. In the rare event that any error in the computation or tabulation of fantasy points, selection of winners, etc., as a result of inaccuracies in or incompleteness of the feed provided by the third party service provider comes to its attention, Panther Fantasyshall use best efforts to rectify such error prior to the distribution of prizes. However, Panther Fantasyhereby clarifies that it relies on the accuracy and completeness of such third party score/statistic feeds and does not itself warrant or make any representations concerning the accuracy thereof and, in any event, shall take no responsibility for inaccuracies in computation and tabulation of fantasy points or the selection of winners as a result of any inaccurate or incomplete scores/statistics received from such third party service provider. User(s) agree not to make any claim or raise any complaint against Panther Fantasy in this respect.


14. PUBLICITY


In an event wherein an individual declared as the winner of Contest(s) accepts the prize offered by Panther Fantasythen affiliates of Panther Fantasyand We ourselves are authorized to use the name, likeness, voice and comments of the winner for various purposes including (but not limited to) advertising, promotion of the company in any media worldwide, alongside trading without any further permissions or consents and/or additional compensation being given to the participant. By accepting the Terms and Conditions, the winners of the Contest(s) provide their consent for being available for promotional purposes as planned and desired by Panther Fantasywithout any charge. The promotional and advertising events can include (but not limited to) press events, internal meetings and ceremonies/functions wherein the dates for the promotional events will be solely decided by the team of Panther Fantasy


15. GENERAL CONDITIONS


In a rare event wherein Panther Fantasyidentifies the need of any governmental, statutory or regulatory compliances or approvals for organizing any Contest(s) and subscription accounts or the company identifies any on-going Contest(s) breaching the legal guidelines or being prohibited by the legal authorities, then, Panther Fantasy hold all the rights to cancel or withdraw such Contest(s) without any prior notice to the Panther Fantasyand their User(s). The individuals using the services provided by Panther Fantasyagree not to make any claims related to such cancellation or withdrawal in any manner. The employees, directors, affiliates, relatives and family members of Panther Fantasy, will not be eligible to participate in any Contest(s).


16. DISPUTE AND DISPUTE RESOLUTION


Any sort of disputes associated with Fun Features or services provided by Panther Fantasyincluding the Contest(s), Panther Fantasy accounts, the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the User(s) (including Participants) or Panther Fantasy shall be undertaken by the courts of competent jurisdiction at Mumbai, maharashtra. All sort of disputes, issues, and questions shall be addressed by the court competent jurisdiction in alignment with the laws of the Republic of India.


In a circumstance wherein a legal dispute arises (legal issue or question) between two parties, the party raising the dispute is bound to provide written notification ("Notification") to the other party involved in the dispute. The parties involved in the dispute should initially focus on resolving the issue post receiving the Notification. However, if both the parties fail to resolve the dispute through mutual discussion within 15 days of receiving the Notification, the dispute shall be resolved by arbitration. Only Panther Fantasyliable to raise the dispute query to Panther Fantasy User(s) may raise their dispute query to only their Fantasy Sports business subscribed member(s), Panther Fantasywill not entertain any Subscribed member(s)’s User(s) dispute between Subscribed member(s) and their User(s) or Subscribed member(s)’s User(s) to Us.


The place of arbitration shall be Mumbai, India. All arbitration proceedings shall be conducted in English and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.


During the arbitration process, the parties involved in the dispute will be complied to follow the arbitration award. Additionally, the parties involved in the disputes will have to bear costs of arbitration on their own and will have to equally share the fees of the arbitrator unless stated otherwise by the arbitral tribunal. The arbitrator is allowed to pass interim orders and awards, including the orders for specific performance and such orders would be enforceable in competent courts. The arbitrator is bound to provide a rational award.


17. RELEASE AND LIMITATIONS OF LIABILITY


User(s) agree to access and use the Panther FantasyServices voluntarily and at their sole risk. Further, accepting not to hold Panther Fantasyresponsible or liable on account of any loss or damage sustained including (but not limited to) any accident, injury, death, loss of property by Users or any other person or entity during the course of access to the Fun Features (including participation in the Contest(s)) or as a result of acceptance of any prize.


Panther Fantasyshall not be held responsible either jointly or individually, for any sort of errors or omissions, neither on behalf of itself nor on behalf of third parties in terms of the prizes.


By accepting these terms and conditions User(s) accepts that he/she shall be held solely responsible for any consequences arising due to an event wherein a user carries out any sort of illegal act due to the non-conformity with these Terms and Conditions and other rules and regulations in relation to Fun Features, including the provision of an incorrect address or other personal details.


The users provide their consent to defend, and hold Panther Fantasy harmless from any third party/entity/organization claims arising due to, or associated with user’s involvement with Panther Fantasy.com or his/her participation in any Contest(s) organized on Panther Fantasy platform.


18. DISCLAIMERS


To the extent permitted under law, neither Panther Fantasynor its parent/holding company, subsidiaries, affiliates, directors, officers, professional advisors, employees shall be responsible for the deletion, the failure to store, the misdelivery, or the untimely delivery of any information or material.


In alignment to the legal bodies, Panther Fantasyshall not be held responsible for any harm faced due to downloading or accessing any information or material, the quality of servers, games, products, Fun Features or sites, cancellation of competition and prizes. By accepting these Terms and Conditions User(s) agree not to make any demands, or claims in the event of suspension or closure of any Services, events or Contests organized/provided by Panther Fantasy.


19. REFUND


Any amount once added to the account of user(s) can't be refunded back to the user(s) in any case, and the amount can be used to join the leagues and Contest(s) organized by Panther Fantasy


21. STANDARD TERMS AND CONDITIONS OF "REFER AND EARN" PROGRAM


Panther Fantasyprovides an opportunity to compete with friends by referring them for joining Panther Fantasy through the Refer and Earn Program of Panther Fantasy. The refer and earn program of Panther Fantasy enables to Refer friends alongside offering you and your referred friends a Cash Bonus of up to Rs.100 in an event wherein user and user’s referred friend meet the criteria and complete all the steps specified in these terms. The Cash Bonus earned by you and your referred friend will be redeemable to join cash contests and contests through the Panther Fantasy’s mobile application for the Android mobile devices. The following Terms and Conditions are defined by Panther Fantasy for participating in the Refer & Earn program. These Terms and Conditions should be followed by the users as they govern the user’s participation in the Program:


The Cash Bonus earned by the referred friend of already registered user with Panther Fantasy is subjected to various Terms and Conditions, and the bonus amount earned will be provided to the Referent on the successful completion of the verification process which includes email verification, mobile verification, and PAN card verification. As soon as the Referent registers on Panther Fantasy a cash bonus of ₹30 will be credited into the Panther Fantasy wallet of the Referent. Further, after the Referent verifies his/her PAN card details, a cash bonus amount of ₹70 will be credited to his/her Panther Fantasyaccount of ₹10 each time user(s) join league until it complete pending cash bonus of ₹70 . In a rare event, if the referred friend of the existing user of Panther Fantasy fails to successfully verify his/her personal and contact details within the Verification Period or omits to provide documents requested for such verification, the Referent shall not be eligible for receiving the entitled Referent Bonus (as specified above).


Panther Fantasy holds all the rights to change or substitute the Cash Bonus offered under the Refer & Earn Program without any prior notice to the user. The crediting of Cash Bonus to the gaming accounts of the Referrer and Referent shall be at the sole discretion of Panther Fantasy and shall be subject to the Referrer’s/Referent’s alignment with these Terms and conditions.


Panther Fantasy reserves the right to:

The Referrer/Referent is not subjected to any winnings, prizes or bonus just because of participating in the Program.


Panther Fantasy is authorized to disqualify any Referrer/Referent at its sole and absolute discretion, in an event if Panther Fantasy identifies any Referrer/Referent to be engaged in any illegal, inadequate or unlawful conduct.


No correspondence, objection or complaints will be entertained by Panther Fantasy regarding the Program, and crediting of Cash Bonus and the decision of Panther Fantasy in this regard would be considered as final and binding.


Panther Fantasy can suspend or deactivate any user account in an event a user is identified to be involved in any sort of spamming on the website of Panther Fantasy or conducting any suspicious on the Platforms of Panther Fantasy.

22. VERIFICATION


In order to create, register and operate an account with Panther FantasyThe user(s) need to verify personal and contact information including (i) Mobile Number, (ii) E-Mail Address, (iii) Pan Card Details; and (iv) Bank Account Details such as, Name, Bank Name, DOB, Branch, IFSC Code, State.


The images provided by the individuals using the services provided by Panther Fantasyshould be scanned copies of the original documents. Further, the image size of the scanned copies of original documents provided by the users for account verification should not exceed 2MB.


By accepting these Terms and Conditions, the users provide their consent to provide adequate and accurate information at the time of verification. Panther Fantasyreserves all the rights to reject the verification application of a user in an event wherein the PAN card details and Account details of the user does not match with each other.


The users using the services provided by Panther Fantasyshould provide the documents demanded by Panther Fantasy, none of the document alternatives would be accepted for the verification process. Further, the PAN card of a user creating and registering an account with Panther Fantasyborn before the year 1968 will not be accepted. In an event wherein the user creating and registering an account with Panther Fantasy is born before the year 1968, the user will be required to provide a verification prof wherein the user should email an image holding his/her PAN card near his/her face at email id given in support tab inside Panther Fantasyapplication.


Any change in the information provided by the user while registration or after should only be entertained if received in writing with a valid document of change. Users are bound to provide the change in their information to Panther Fantasyfor updating their records in the system. If the user fails to provide the same, the user shall be held solely responsible for failure in receiving communication updates from Panther Fantasyor Subscribed Member(s).


23. GENERAL TERMS & CONDITIONS FOR PAN CARD AND BANK ACCOUNT



PAN CARD


A pan card once uploaded by the user and verified from our end can be deleted anytime if found or suspected to be a forged document.


In case the documents are found or believed to be fake, the user account can be blocked under “fair play violation”.


In case a user is found to be a resident of Assam, Odisha, Telangana or Nagaland after the pan card verification, his/her pan card can be deleted anytime even after the verification.


BANK ACCOUNT


A bank account once uploaded by the user and verified from our end can be deleted anytime if found or suspected to be a forged document.


The withdrawals can be withheld if the uploaded documents are found or believed to be fake amid or after the bank account verification.


In case a user is found to be a resident of Assam, Odisha, Telangana or Nagaland after the bank account verification, his/her bank account can be deleted anytime even after the verification.


All state bank accounts have been merged to SBI, thus, make sure the IFSC entered by you should be the new IFSC.


It is mandatory that the bank account number on the verification image should match exactly with the account number entered in details. The “0s” mandatory to be mentioned in the details.


24. TAXATION


The winnings, cash bonuses and prizes are subjected to various taxes. In an event, the winning amount of a user crosses the mark of ₹10,000, a 31.20% taxation charge will be imposed on the winning of the user


25. WITHDRAWALS


The withdrawal request of a user is processed within 24 working hours (herein the working hours refers to bank’s working hours) excluding the date the request is made. In case, your withdrawal request is not processed within 24 working hours after the date the request is made; please check your registered email address provided by you at the time of registration for any communications from user(s). In an event, any Panther Fantasyuser is found to be violating the Fair Play Terms, or in general Terms & Conditions of the Panther Fantasyapplication and website then Panther Fantasyat its sole and absolute discretion holds all the rights to take strict measures against the users including (but not limited to):


  1. In an event a user is found having more than 9 referred friends whose mobile number, email address or PAN card details are not verified, then the withdrawals requests of the user can be put on hold, or his/her user account can be blocked permanently.
  2. The withdrawals of users found to be creating a fake refer chain by creating multiple ids under the same name to earn the Refer & Earn bonus will be blocked from using Panther Fantasy services provided by the platform alongside putting their withdrawal requests on hold.
  3. In an event, any user is identified to be a resident of Assam, Odisha, Telangana or Nagaland amid the Panther Fantasy audits and had hidden this fact while registering at the platform will be blocked, and his/her withdrawal requests will be put on hold.

In case you are a Winner on Panther Fantasy and is asked to provide user(s) details (contact details, images, etc.) for promotions, then it is mandatory for you to provide your consent for using the details, photographs, and rights to use your photographs for social media and all other sorts of promotions. In case, you disagree with providing the required details then withdrawal request shall be put on hold by Panther Fantasy.
